Buyer understands and agrees that the kittens (hereafter called “Kitten” or «Kittens») described below is being purchased as an INDOOR pet and is sold with NO BREEDING RIGHTS.

The Buyer may pay nonrefundable deposit with Venmo, Zelle, Cash App, Paysend. The Buyer may pay the balance owed with Venmo, Zelle, Paysend, Cash App, cashiers check or cash. No personal checks will be accepted.
A $500 nonrefundable deposit reserves Kitten until final payment is made. Final payment must be paid 5 calendar days prior to shipping or pick-up day. If final payment is not received within this time frame listed above, kitten will be made available to others to purchase, and Buyer will forfeit deposit.

- Right to Cancel / Refund Policy
1.1. The Seller reserves the right to cancel the purchase at any time before the kitten is transported if the Seller becomes aware of any circumstances regarding the Buyer that may render the new home unsuitable for the kitten. Such circumstances may include, but are not limited to: the presence of other pets that may pose a risk, inadequate living conditions, history of animal abuse or neglect, refusal to comply with vaccination or spay/neuter requirements, or other factors that may endanger the welfare of the kitten.
1.2. In such cases, the Seller will refund all money paid for the kitten using the same method of payment, except for the non-refundable deposit of $500, which will be retained by the Seller. Refunds will be processed within fourteen (14) business days of cancellation.
1.3. In the event of the kitten’s death prior to pick-up, the Seller will offer a full refund of any money paid toward the purchase price of the kitten, upon presentation of documentation confirming the kitten’s death (such as a veterinary report).
1.4. The Buyer acknowledges and agrees that cancellation under this clause does not entitle the Buyer to any additional compensation, damages, or claims beyond the refund specified herein.
1.5. Refunds will be made using the same payment method used by the Buyer, unless otherwise agreed in writing by both Parties.
- The Breeder’s guarantees.
- The Breeder guarantees, that if within the 12 months of the Kitten's life, it is determined through an examination by a licensed veterinarian (if the Kitten is ill) or by necropsy (if the Kitten has died), that such illness or death is the direct result of its having one or more of these -HCM, SMA, PKDEF-genetic conditions. Buyer shall notify Breeder and provide a copy of the written medical examination or necropsy with Microchip number. Buyer may request a replacement kitten of equal value in the same manner as set forth below. No medical or shipping costs will be refunded, and no monetary refund will be offered in exchange for a kitten.
- The Breeder guarantees the health of the Kitten upon delivery, pick-up from the cattery, or upon the time of shipment for a period of seventy-two (72) hours. This
period begins at the point that the Kitten leaves the possession of the Breeder, whether it is at the cattery or at some point of shipping/delivery.
- The Kitten goes to the Buyer with a health record and age appropriate FVRCP , Rabies vaccine, microchip. If the Kitten is found to have a medical problem (within the 72-hour period only), it must be reported to the Breeder within twenty four (24) hours of its discovery. Failure to make this report within 24 hours of its discovery will void the guarantee.
- The Seller guarantees that kitten is in sound health and not harboring any parasites.
- Seller will provide Buyer with kitten health certificate at pickup.
- Seller guarantees general health of kitten for seventy two (72) hours on the condition that the Buyer has kept kitten in proper living environment and is kept quarantined and on recommended diet.
- 7.The Seller guarantees that the kitten is Feline leukemia negative and negative for FIV. The Cattery will replace any kitten that dies from FIP within a three (3) month period following the pick-up date ONLY upon receipt of an appropriate necropsy report with Microchip number paid for by the Buyer.
- Quarantine.
Buyer agrees to place the new Kitten in quarantine(isolation from other pets) for no less than 14 calendar days.The Kitten should be provided with plenty of attention and not left alone for extended periods of time.
- Vaccination Policy.
- Your kitten/cat received all the necessary vaccinations prior to leaving the cattery.
Over-vaccination is known to cause many auto-immune diseases and conditions in cats. The buyer will be supplied with a list of vaccinations that have been administered to the kitten. Do NOT allow your vet to repeat any of the vaccinations that have already been given by the breeder until ________. If your kitten is re-vaccinated before that date this will void this contract.
- Do NOT allow your vet to give multiple vaccinations at any time during a vet visit. Your kitten's next vaccination booster should be after 1 year of age.
- Parasite control.
The Buyer will keep this Kitten free of external and internal parasites such as fleas and worms. Buyer should use a topical solution (such as Revolution) and never an over the counter solution (OTC) and NEVER flea dip the Kitten, as cats are very sensitive to these chemicals.
- Authorization to Obtain Veterinary Information
- The Buyer hereby acknowledges and agrees that the Breeder has the right to request and obtain from any veterinary clinic where the purchased cat is treated any and all information related to the cat’s health, medical history, vaccinations, treatments, and examinations.
- The Buyer agrees to notify the chosen veterinary clinic of this authorization and, if necessary, to sign any additional consent forms (Authorization Release) required by the clinic.
- The Buyer also agrees to provide the Breeder, upon request, with the name, address, and contact details of the veterinary clinic where the cat is being treated.
6.3.1. The Buyer must inform the Breeder immediately of any illness, deterioration in health, or significant changes in the cat’s behavior.
- The Breeder agrees to use the obtained information solely for the purpose of verifying the cat’s health, fulfilling the health warranty obligations under this Agreement, and, if necessary, for use in legal proceedings.
- This authorization shall remain valid for the lifetime of the cat and may not be revoked by the Buyer without the Breeder’s written consent.
- Authorization for Use of Photos and Videos.
- The Buyer hereby acknowledges and agrees that any photographs or videos of the purchased cat posted by the Buyer on social media, messaging platforms, websites, or other public sources may be used, reposted, and shared by the Breeder on the Breeder’s social media accounts, website, and promotional materials.
- The Breeder may use such content in its original form or with edits (cropping, quality enhancement, adding text or the cattery logo).
- The Breeder may use, repost, or share any photographs or videos of the kitten freely, provided that no identifiable faces of children or adults are visible. If any photograph or video depicts the face of a child or any identifiable person, the Breeder must obtain the Buyer’s prior written consent before reposting, sharing, or using such content.
- The Buyer confirms that the use of photographs and videos of the cat does not require additional consent or compensation, and this authorization is granted for an unlimited duration.
- Buyer’s Responsibility for Expenses
- The Buyer assumes responsibility of all expenses incurred in relation to the Kitten after said Kitten leaves the possession of the Breeder, as well as being responsible for any expense incurred at the request of the Buyer before the Kitten leaves possession of the Breeder.
- Buyer understands this Kitten has been kept in an optimum environment for socialization and development, and agrees to follow recommendations provided at time of transfer for diet, 14-day quarantine/isolation, and transition.
- Due to environmental factors out of Breeder's control, behavioral issues do not serve as reasons for replacement or refund.
- Diet and Nutrition Requirements.
- The Buyer agrees to provide this Kitten with high-quality cat food in appropriate quantities. The Breeder has made every effort to feed the Kitten a high-quality diet. Buyer agrees that, for the health of this kitten, a high protein diet will be continued for the life of this Kitten.
- Cats are obligate carnivores and should be fed as such. Failure to comply with the diet requirements is grounds for forfeiture of Kitten to the Breeder, plus forfeiture of all monies paid by Buyer.
- No Declawing. The Buyer agrees that this Kitten will not be declawed.
- Living Environment.
- The Buyer agrees that this Kitten will be kept indoors only, as they statistically have a longer -healthier – lifespan, unless on a leash, in a carrier, or in a suitably protected enclosure under direct supervision.
- Right to Inspect Living Conditions. The Breeder reserves the right to verify the living conditions of the kitten if there is reasonable concern that the kitten may be subjected to abuse, neglect, or inadequate care. Verification may be conducted remotely via live video call, pre-recorded video, or photographs, at the Breeder’s discretion. The Buyer agrees to provide prompt access to such visual evidence upon request. Failure to comply with this provision may be considered a material breach of this Agreement, giving the Breeder the right to reclaim the kitten immediately and take any necessary legal action.
- Confidentiality. Both parties agree not to disclose personal information of the other party, including full name, address, and private correspondence, without prior written consent from the respective party.
- Return, Rehoming, First Refusal.
- Under no circumstances will this Kitten be sent to a shelter or otherwise disposed of, nor shall this cat/Kitten be sold, leased, or given away to any pet shop, research laboratory or similar facility.
- In the event that the Buyer becomes unable or unwilling to continue caring for the Kitten/Cat, the Buyer must first notify the Breeder. The Buyer shall return the animal to the Breeder free of charge, with full transfer of ownership rights. The Breeder shall have the rights, at the Breeder’s sole discretion, resell or rehome the animal to another client. In the event of a successful resale, the Buyer shall be entitled to receive the resale proceeds, less a twenty percent (20%) fee retained by the Breeder for expenses, as well as any applicable sales taxes.
- The Buyer shall not give away, sell, gift, transfer, or otherwise rehome the Kitten/Cat to any third party without prior written notification to, and approval from, the Breeder. Any such transfer made without the Breeder’s consent shall constitute a material breach of this Contract. In the event of such breach, the Breeder shall have the right to pursue legal action and seek all available remedies, including but not limited to damages, injunctive relief, and recovery of attorney’s fees and court costs.
- Buyer agrees to forfeit all monies paid for Kitten and the Breeder has the right to retrieve said Kitten if Buyer does not adhere to all provisions of this contract, or if the Kitten is being neglected or abused.
- If the Buyer wishes to resell this Kitten, Breeder must approve the sale; alternatively, Kitten will be returned to Breeder, at Buyer's expense, for re-sale by Breeder.
- Communication and Updates.
- Breeder will inform the Buyer of any changes in Breeder's email address, street address or telephone number and requests the same courtesy from the Buyer.
- Buyer is encouraged to send updates, news and photos of the cat/Kitten to the Breeder.
- Dispute Resolution and Confidentiality.
- The Breeder and the Buyer agree to resolve the problems associated with the kitten together and confidentially, without the presence of third parties, respecting each other, personal rights, and reputation.
- If negative information about Cat Paravel cattery or its owners is transmitted, disclosed, or distributed without the prior written consent of the Breeder, the Buyer may be held liable for any and all damages including but not limited to, compensatory and punitive - and any legal fees that Breeder may incur.
- Buyer's failure to honor any of the terms and conditions of this Contract will result in the ownership of the Kitten being reverted to the Breeder, with no compensation due to the Buyer.
- Breach of contact.
- Buyer may be subject to damages up to $10,000 for breach of this Contract. Buyer may also be required to pay any legal fees Breeder may incur in connection with the enforcement of the terms of this Contract.
- It is agreed that any legal action taken to enforce the terms of this Contract will be in Dakota County Civil Court, Apple Valley, Minnesota and will be governed by Minnesota State Law.
- Acknowledgment & Legal Effect.
- The Buyer acknowledges that they have read, understood, and accepted all responsibilities, obligations, and risks associated with purchasing a live animal, and agree to all terms and conditions of this Contract.
- Both Breeder and Buyer acknowledge that this Contract constitutes a legally binding agreement under the laws of the State of Minnesota. The Buyer confirms that they have had the opportunity to ask questions regarding this Contract and seek legal advice if desired.
- Both parties acknowledge that they have received a copy of this Agreement for their records.
